Terms of Service

1. The service
Letter Kit is a service of STACHOLD GROUP LLC ("we", "us") for composing newsletters, sending them by email to people who have subscribed, and publishing them at public web addresses. It is operated from Athens, Texas, United States, and these terms are an agreement between you and that company.
2. Your account
You are responsible for what is sent from your account and for keeping your credentials to yourself. You must be old enough to enter a contract where you live. One person or organisation may hold an account; you may invite others to it, and their actions are your responsibility.
Before your account can send anything, it must have a valid postal address on file. This is a legal requirement for commercial email in the United States, and it appears in the footer of every message you send.
3. Your list
You may only send to people who asked to hear from you. Every subscriber added to Letter Kit confirms by email before they become active, including subscribers you import — importing a list does not skip confirmation.
You may not use Letter Kit to send to purchased, rented, scraped or harvested lists. See the acceptable use policy, which forms part of these terms.
4. Your content
Your issues, your subscriber list and everything else you put into Letter Kit remain yours. You grant us only the permission needed to run the service: to store your content, to send it to the addresses you direct, and to publish the issues you choose to make public.
You can export your subscribers at any time, in full, in a standard format.
5. Credit and payment
Sending is paid for in advance with credit. One credit sends one email to one recipient. Credit is purchased in blocks of 10,000 for $10 USD.
- A send that would require more credit than your balance holds is refused before it begins. We will not send part of an issue, and we will not bill you for an overage.
- Credit that is unused at the end of a calendar month expires and is not carried forward.
- Credit has no cash value, cannot be transferred between accounts, and is not refundable once purchased, except where the law requires otherwise or where we have charged you in error.
- Where a recipient is refused outright by the mail service, the credit reserved for that recipient is returned to your balance.
Payments are processed by Stripe. We do not receive or store your card details.
6. Availability
We aim to keep the service running and will tell you about planned interruptions, but we do not offer a guaranteed uptime figure and the service is provided as it is. Email delivery depends on receiving mail servers we do not control; we cannot guarantee that any particular message arrives in any particular place.
7. Suspension and termination
You may close your account at any time. We may suspend or close an account that breaches these terms or the acceptable use policy, that generates bounce or complaint rates which put other customers' delivery at risk, or where we are required to by law. Except where the breach is serious or urgent, we will tell you first and give you a chance to put it right.
When an account closes, its subscriber lists and content are deleted. Export anything you want to keep before closing it.
8. Liability
To the extent the law allows, our total liability to you for any claim relating to the service is limited to what you paid us in the twelve months before the claim arose. We are not liable for lost profits, lost business, or indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.
9. Changes
We may change these terms. If a change materially affects you, we will give reasonable notice by email before it takes effect. Continuing to use the service after that is acceptance of the change.
10. Governing law
These terms are governed by the laws of the State of Texas, United States, and the courts there have exclusive jurisdiction.
